Andrea Rosa, Attorney at Law

Ms. Rosa, an attorney and member of the California State Bar, is the founder and principal manager of The Rosa Law Group. For the past four years she has served as the Deputy Director for Legislation and Policy Development of the California Department of Fair Employment and Housing. As Deputy Director, Ms. Rosa planned, organized, and directed the Department's legislative program and served as principal policy advisor to the Director. Ms. Rosa also directed the Department's employment and housing mediation programs. During her tenure with the Department, she trained employers around the state on issues relating to employment law. She participated in a diverse number of training seminars and workshops regarding the Department's mediation programs, housing and employment discrimination law.

Ms. Rosa has served as Counsel and Consultant in the California State Senate where she served as Counsel to the Senate Judiciary Committee and Counsel and Consultant in the Office of Senate President Pro Tempore Bill Lockyer and later to Senate President Pro Tempore John L. Burton. She has also served as attorney for Legal Services of Northern California where she litigated major impact precedent-setting cases. She was also instrumental in establishing a dissolution and temporary restraining order clinic for the poor and established an intake process for Spanish monolingual clients.

WORK EXPERIENCE:

TRAINING

Conducts employment training designed to provide employees, managers and supervisors with the analytical tools to evaluate and respond to situations where discrimination/harassment has occurred and situations, and to improve effectively interpersonal interactions.

INVESTIGATION

Conducts employment related investigations for employers. Previous investigations include conducting, supervising and overseeing in-house investigations for the Department of Fair Employment and Housing. On-going investigations include East Bay Municipal Utility District. Investigations include all aspects of employment, including harassment, discrimination, whistleblower, retaliation, and discipline and discharge.

MEDIATION

Provides employers with qualified mediators to resolve employment related disputes. Developed and implemented mediation program for the Department of Fair Employment and Housing's employment and housing mediation programs. Trained individuals to qualify as mediators pursuant to California law.

LEGAL COUNSELING AND ADVICE

With an emphasis on labor law and employment discrimination, clients include small and medium size employers, some individuals and labor unions. Representation on labor issues, contract negotiations, discipline and discharge, duty of fair representation and individual discrimination.

Teaches employment and labor law, torts and legal research at several local colleges.

2000-2004 DEPUTY DIRECTOR, LEGISLATION AND POLICY DEVELOPMENT

California Department of Fair Employment and Housing (DFEH)

  • Planned, organized, and directed the department's legislative, and policy development functions.
  • Designed, implemented, and directed the department's employment and housing mediation programs.
  • Served as the Director's principal policy advisor.
  • Served as Director's principal legislative and policy liaison to the Legislature, other state agencies and the Office of the Governor.
  • Conducted training presentations for the private sector (both complainants and respondents) including sexual harassment, ADA issues, gender discrimination, and other protected areas.
  • Worked closely with state, federal and local government agencies, civil rights groups, and community organization to educate the public about their rights and responsibilities.

1998-2000 PRINCIPAL LEGISLATIVE POLICY CONSULTANT

Office of the President Pro Tempore, Senator John Burton

  • Researched, tracked, analyzed and prepared policy analysis on a broad range of subject matters including constitutional amendments, public safety, finance and business issues for the Pro Tem's Policy Office.
  • Advised and made recommendations to the President Pro Tem on policy and legislation pertaining to, among other subjects, criminal justice, juvenile delinquency, and hate crimes.
  • Represented the Pro Tem with community groups, business organizations, state and federal agencies and the general public on legislation and policy issues.

1994 -1998 LEGAL COUNSEL/PRINCIPAL POLICY CONSULTANT

Office of the President Pro Tempore, Senator Bill Lockyer

  • Similar duties as described above in the areas of health, family law, judiciary, insurance and criminal justice.
  • Advised and made recommendations to the President Pro Tem on legislation pertaining to complex policy and legal matters in the areas of employment law, civil rights, fair housing laws, alternative dispute resolution, court administration, family law, child and juvenile delinquency, tort reform, anti-slap and other court related issues.

1990- 1994 PRINCIPAL CONSULTANT Senate Judiciary Committee, Senator Bill Lockyer, Chair

  • Reviewed, researched, gathered factual data, and analyzed legislation for the committee and its members.
  • Drafted and negotiated legislation with local and national business organizations, community groups, legislative members and staff on different controversial and complex criminal and civil judiciary issues.
